These Terms and Conditions form a legally binding agreement between you (the "Client") and Potential Green LDA, operating under the brand "Rides on Clouds" (referred to as "we", "us", "our", or "Ana-Maria"). By proceeding with a booking or utilizing our services, you confirm that you have read, understood, and agree to these Terms and Conditions.

Our services encompass private tailor-made tours in Madeira, Portugal, as detailed in your personalized itinerary.

• Booking Lead Time: We recommend booking 2-3 months in advance to secure your preferred dates, especially during peak seasons. While we strive to accommodate all requests, closer bookings depend on our availability.
• Deposit: A non-refundable deposit, typically 20-30% of the total tour cost, is required to confirm your booking. The precise deposit amount will be communicated during the booking process based on your itinerary's specifics.
• Confirmation: Your booking is officially confirmed upon our receipt of the deposit. A confirmation email detailing your tour will then be sent.

• Daily Rate: The standard daily rate for a private, full-day tailor-made tour with Ana-Maria is 380€.
• Overtime Charges: Tours extending beyond the typical 7-8 hours will incur an additional charge of 50€ per hour.
• Payment Methods: We accept payments via bank transfer and major credit cards. The remaining balance can also be paid in cash on the first day of the tour.
• Balance Due: The outstanding balance for your tour is due on the first day of service, or as otherwise explicitly agreed upon.

Ana-Maria provides personalized tour planning and companionship. Services include:

• Accompanied Activities: Guided trails and levada walks on marked, safe paths (Ana-Maria is not a certified high-adventure hiking guide); island exploration tours; and focused Funchal tours.
• Culinary & Local Insights: Curated lunch & dinner recommendations and unique gastronomic tour planning, provided without commission. Authentic local insights and recommendations are offered.
• Flexibility: Ana-Maria will accompany you on all planned activities. If you prefer independent exploration for any part of your itinerary, please inform us, and suitable arrangements will be made.

Important Note: Our guided walks prioritize enjoyment and immersion in nature at a comfortable pace, suitable for families and casual walkers. We do not provide services for high-adventure or professional-level hikes.

Clients are responsible for:

• Adhering to Ana-Maria's instructions and safety briefings during the tour.
• Ensuring they have the appropriate physical fitness and equipment for chosen activities, particularly walks.
• Disclosing any relevant health conditions, mobility issues, or special requirements prior to the tour.
• Behaving respectfully towards local customs, culture, and the environment.
• Understanding that Ana-Maria acts as a companion and planner, not a certified professional guide for hazardous or high-level hiking.

Changes by Client:

• Itinerary Adjustments: We will make every effort to accommodate last-minute adjustments to your itinerary, subject to availability and potential additional costs.
• Cancellation Policy:
  • Full Refund: For cancellations made at least one week (7 days) prior to the service start.
  • 50% Refund: For cancellations made at least three days (72 hours) prior to the service start.
  • No Refund: For cancellations made within 1 or 2 days (48 hours) of the service start.
• Exceptional Circumstances: In cases of truly unavoidable major events (e.g., significant flight disruption or other critical reasons beyond your control), please contact us immediately. These situations will be evaluated individually, and a full refund may be offered even with less than 48 hours' notice, based on fairness.

Changes or Cancellation by Potential Green LDA / Rides on Clouds:

• While rare, we reserve the right to modify or cancel a tour due to unforeseen circumstances beyond our control (e.g., severe weather, natural disasters, safety concerns, operational issues).
• In such events, we will endeavor to offer suitable alternative arrangements. If no suitable alternative is possible or acceptable to you, a full refund for the affected services will be issued.

Potential Green LDA (Rides on Clouds) acts as an independent tour planner and companion, dedicated to providing a safe and enjoyable experience. However:

• We are not responsible for injuries, damages, losses, delays, or expenses incurred by clients due to acts or omissions of third-party service providers (e.g., restaurants, attractions, independent transport beyond our direct control).
• Clients participate in all activities at their own risk. We strongly advise adherence to safety instructions provided.
• Our liability for any direct loss or damage arising from our services is limited to the amount paid by the client for the specific tour package.

We strongly recommend that all clients purchase comprehensive travel insurance that covers personal accident, medical expenses, baggage loss, cancellation, curtailment, and personal liability before commencing their tour.

Your privacy is important to us. Any personal information collected during the booking process will be used in accordance with our Privacy Policy. Please refer to our separate Privacy Policy page for full details.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Portugal, with exclusive jurisdiction for any disputes residing in the courts of Madeira, Portugal.
